Manufacturer Warranty & Insurance Write-Off Vehicles (Category N, X & S)

Where a vehicle has been an insurance category write-off during a manufacturer warranty period, the warranty should still remain valid; this does not exclude the manufacturer from unfair trading obligations. They may however, act reasonably and a component previously damaged or if found to have been impacted as a result of the write-off classification may not be covered, or may be limited by future warranty claim. Components deemed not impacted, should still be covered under the existing manufacturer warranty. Where this isn't the case, we will honour 1 year warranty coverage (or to the end of the manufacturer warranty period, whichever is sooner) as part of our Prestige+Component warranty package, subject to policy terms.

Category N and Category S vehicles can represent excellent value and, when properly repaired, can provide reliable ongoing use.

1. Introduction

This document explains how a vehicle’s previous insurance write-off status—Category N (non-structural damage) or Category S (structural damage)—may affect any remaining manufacturer warranty.

Our aim is to provide clear, fair, and transparent information so you can make an informed decision with confidence.

 

2. Manufacturer Warranty – The Key Point

If the vehicle you are purchasing remains within the manufacturer’s original warranty period (for example, typically 3 years or 60,000 miles), then:

✔️ The manufacturer warranty is not automatically void due to Category N or S status
✔️ The warranty is generally attached to the vehicle and transfers to subsequent owners

This means the vehicle may continue to benefit from manufacturer warranty support, subject to the manufacturer’s terms and conditions.

 

3. Legal Position (UK Consumer Law)

Under UK law, a manufacturer cannot simply exclude all responsibility where a warranty has been provided.

Relevant legislation includes:

  • Consumer Rights Act 2015
  • Consumer Protection from Unfair Trading Regulations 2008

Where a manufacturer provides a warranty:

  • It must be honoured in accordance with its stated terms
  • Any exclusions must be reasonable, clear, and transparent
  • The manufacturer cannot apply blanket exclusions that are unfair or misleading

In addition:

  • Safety-related obligations (such as recalls) are governed by product safety laws and continue regardless of ownership or write-off status


A manufacturer cannot automatically void an entire warranty solely because a vehicle has been categorised as Category N or S.

 

4. How the Warranty May Be Affected

While the warranty may remain in place, it is important to understand that it may be limited in scope.

Manufacturers commonly exclude:

  • Damage arising from the original accident or incident
  • Parts or systems affected by that damage
  • Faults or issues considered (at the manufacturer’s discretion) to be directly or indirectly related to the incident or subsequent repairs

The warranty is likely to remain valid for unaffected parts of the vehicle, but may not apply to areas previously damaged or repaired.

 

5. What Is Still Typically Covered

Subject to the manufacturer’s terms and assessment, the warranty will generally continue to cover:

  • Manufacturing or material defects unrelated to the previous damage
  • Mechanical or electrical faults not connected to the write-off incident

In addition, the manufacturer will continue to meet its legal and technical obligations, including:

  • ✔️ Safety recall work (required under UK product safety law)
  • ✔️ Software updates and technical campaigns
  • ✔️ Rectification of manufacturing defects within valid warranty scope

These services are carried out by the manufacturer or its authorised repair network.

 

6. How Warranty Decisions Are Made

All manufacturer warranty claims are:

  • Assessed solely by the manufacturer or its authorised repairers
  • Considered on a case-by-case basis
  • Subject to inspection and technical evaluation

The manufacturer will determine whether a fault is covered, including whether it is connected in any way to the vehicle’s prior damage history.

 

7. Servicing and Maintenance Requirements

To preserve any remaining manufacturer warranty (where applicable), you must ensure:

  • The vehicle is serviced in accordance with manufacturer schedules and guidelines
  • Appropriate parts, fluids, and procedures are used
  • Accurate service records and supporting documentation are retained

Failure to comply with these requirements may invalidate some or all of the warranty.

 

8. Our Commitment to You

We will:

  • Clearly disclose the vehicle’s Category N or Category S status
  • Confirm, where possible, whether the vehicle is within the manufacturer’s warranty period
  • Provide available service history and documentation

We are committed to transparency and helping you make an informed purchase.

 

9. Important Information & Disclaimer

While a manufacturer warranty may still apply, you acknowledge that:

  • The warranty may be limited, restricted, or excluded in part, particularly in relation to previous damage
  • Certain repairs or faults may not be covered, especially where linked (directly or indirectly) to the prior incident
  • All warranty decisions are made solely by the manufacturer in accordance with their terms and applicable law

Accordingly:

  • We do not provide, administer, or control the manufacturer warranty
  • We make no representation or guarantee that any particular fault or repair will be covered
  • We shall not be liable for any refusal, limitation, or rejection of a manufacturer warranty claim by the manufacturer

Nothing in this document excludes or limits your statutory rights under:

  • The Consumer Rights Act 2015
  • The Consumer Protection from Unfair Trading Regulations 2008
  • Any other applicable UK consumer or product safety legislation
